Unless explicitly stated to the contrary any new features including new content, our provision of new products and services, or resources shall be subject to these Terms.
7. Purchasing products on the site
To order any product on the Site (“Product”) you will need to contact us via email at email@example.com, telephone us on 020 3217 8259 or fax us on 020 7488 4232 and then follow the ordering procedures set out in these Terms. Details of prices for the Products, and the procedures for payment and delivery are displayed on the Site.
Any times or dates stated on the Site for delivery are estimates only. We will make all reasonable effort to deliver goods within the time specified, but do not accept liability for any failure to deliver within that time.
You must pay by credit or debit card or cheque at the time of order. The price of any Product is the price in force at the date and time of your order. We may change the price of any Product before you place an order. We try to ensure that our prices displayed on the Site are accurate but the price on your order will need to be validated by us as part of the acceptance procedure (see clause 6.4 below). We will inform you if a Product’s correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the product at the correct price. The prices are inclusive of delivery costs and applicable taxes.
All advertisements for goods or services on our Site are merely invitations to treat, and may be withdrawn by us at any time. We are entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by (‘Confirmation’) to the address you have given us on ordering. The order will then be fulfilled either at the time of Confirmation or within 30 days of Confirmation.
You undertake that all details you provide to us for the purpose of purchasing Products which may be offered by us on the Site will be correct, that the credit or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any goods or services. We reserve the right to obtain validation of your credit or debit card details before providing you with any Products.
You may return any Products you have purchased within 7 working days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing or other durable medium (including e-mail) within those 7 working days. You will then be entitled to a refund from us, which will be paid as soon as possible, but in any event within 30 days. You must arrange for and pay the costs of returning the Products to us. If you fail to return the goods to us then we will deduct from the refund the cost of recovering the Products from you. On request, we will collect the Products from you, but the cost of this will be charged to you and we may deduct this from the refund. While in your possession, you must keep any Products you intend to return to us in good condition.
- the Product delivered is not what you ordered, or does not correspond with its description;
- the Product delivered is not of a satisfactory quality; or
- the Product is not fit for any other purpose for which you have bought it and you notified us of this purpose before purchase, and we have not informed you that the Product is not fit for that purpose;
- we will, at our option, deliver to you a replacement Product or refund to you the price paid and your reasonable costs of returning the Products.

9. Reliance of information
Because the Site is provided by means of website and telecommunication systems (including local loop network providers and other connectivity arrangements over which we have no control) you acknowledge and agree that:
We will try to make the Site available but cannot guarantee that the Site will operate continuously or be error free (there may be, without limitation, errors in software used to provide the Site and the Information and errors caused by telecommunications links) and we shall be under no liability for the consequences arising from any such error or the reliance by you upon the Site.
Time shall not be of the essence in relation to our delivery and/or provision of the Site including without limitation provision of the Information and/or Publications.
You should independently verify all Information, figures and rates provided on the Site prior to your use of such Information, figures and rates. We may change, update or correct any such Information, figures or rates at any time without notice. Please note that the Site may contain typographical errors and other inaccuracies.
10. Limitations of liability
We warrant that for any Product you purchase from the Site:
We have the right to sell the Product to you;
- the Product will correspond with the description we have given to you;
- the Product will be of satisfactory quality; and
- the Product will be fit for any other purpose for which you have bought it where you notified us of this purpose before purchase, and we have not informed you that the Product is not fit for that purpose;
Subject to this, however, Products are not sold as being fit for any particular application or for use under specific conditions, unless expressly agreed in writing.
Subject to clause 9.1 we exclude all other express or implied terms, conditions, warranties, representations or endorsements whatsoever with regard to the Products, the Site or any Information provided through the Site.
We will do our best to ensure that all materials and Information published on the Site are accurate, but please note that all content, materials and Information are provided on an ‘as is’ basis and you assume total responsibility and risk for your use of the Site and use of all Information.
We accept no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect) in each case, however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of the Site other than as a direct result of purchasing Products (which shall be subject to the exclusions and limitation of liability set out in these Terms), we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on our part or our servants, agents or any other person or entity.
If we are liable to you for any reason (other than death or personal injury arising from our negligence), our liability will be limited to either £100 or the amount paid by you for the Product concerned, whichever is the greater.
Notwithstanding any other provision of these Terms, we do not attempt to exclude or limit our liability for death or personal injury resulting from our negligence or for our fraudulent representation in any way.
You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use the Site and is compatible with the Site. You also understand that we cannot and do not guarantee or warrant that any material available for downloading from the Site will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for taking sufficient precautions and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
The limitations and exclusions in this clause do not affect your non-excludable statutory rights and only apply to the extent permitted by applicable law.
No rights are conferred on any person who is not a party to these Terms.
Each provision contained in these Terms shall be severable from any other provisions, and if any part of any provision shall be found to be invalid, illegal or void for any reason such invalidity, illegality or void shall not affect any other part of such provision or any other provision contained in the Terms which shall continue to have full force and effect.
Any failure or delay by us enforcing an obligation or exercising a right, under these Terms, does not amount to a waiver of that obligation or right or any other obligation or right.
You acknowledge that you have not entered into these Terms in reliance on any statement or representation, except in so far as the representation has been incorporated into these Terms. You irrevocably and unconditionally waive any right you may have to claim damages and/or to rescind these Terms by reason of any misrepresentation (other than a fraudulent misrepresentation) not contained in these Terms.
You shall not assign any of your rights or obligations under these Terms without our prior written consent. We shall have the right to assign or otherwise delegate all or any of our rights or obligations under these Terms.
These Terms shall be construed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

Notice will be deemed received when an e-mail is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the date of posting.
